Terms and Conditions of Sale (Shop)

§ 1 Scope, provider

These Terms and Conditions of Sale apply to all orders of physical products (in particular InkMe eInk displays) through the InkMe shop. The provider and seller is Rafael Banzhaf, John-F.-Kennedy-Allee 55/5, 71686 Remseck am Neckar, Germany, email: info@ink-me.de.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.

§ 2 Conclusion of contract

The presentation of products in the shop does not constitute a legally binding offer but an invitation to order. By clicking the order button "order with obligation to pay" you submit a binding offer to purchase the goods in your cart. The contract is concluded when we accept the order by an order confirmation or by delivery. Receipt of the order is confirmed without undue delay; this confirmation does not yet constitute acceptance of the contract.

§ 3 Prices and shipping costs

All prices are in euros and include statutory VAT. In addition, the following shipping costs apply:

§ 4 Payment

The following payment methods are available: PayPal, credit card (Visa, Mastercard), Klarna (invoice/instalment) and instant bank transfer. The purchase price is due for payment upon conclusion of the contract; for purchases on account, the payment deadline stated during the ordering process applies.

§ 5 Delivery

Delivery is made to the delivery address you provide. The estimated delivery time is 3–5 business days within Germany and 5–10 business days to other EU countries after conclusion of the contract or – for advance payment – after receipt of payment. We inform you of any differing delivery times during the ordering process.

§ 6 Retention of title

The delivered goods remain our property until full payment has been received.

§ 7 Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in the separate right of withdrawal policy.

§ 8 Warranty / liability for defects

The statutory provisions on liability for defects apply. In the event of defects in the delivered goods, you are entitled, within the scope of the statutory provisions, to subsequent performance, withdrawal, price reduction or damages.

§ 9 Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of a material contractual obligation and limited to the foreseeable damage typical for the contract. Otherwise liability is excluded.

§ 10 Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the state in which the consumer has their habitual residence remain unaffected. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
